Legal Question in Insurance Law in Pennsylvania
Settling without car insurance
I was recently involved in a minor car accident where I was at fault. The other party and I agreed to settle without insurance. The total repairs amount to approx. $1000.00. Is there some sort of legal document that could be drawn up to protect me from any future legal involvement with this person? He wants payment via cashier's check. I don't want him to come after me later saying that we were not settled.

Do not make any payment unless and until, the other party signs a release. The release should provide for a release for both property damage and personal injury. Any lawyer can prepare the release for you at minimal expense.
Re: Settling without car insurance
You want to have him sign a general release (one that will cover personal injury claims as well as property damage claims) and exchange it for the check. An attorney can draw this up for you and I think a flat fee for this service would be appropriate.
Re: Settling without car insurance
You need to enter into a satisfaction agreement for the reasons and fears you m entioned. The actual wording of the satisfaction agreement will depend largely on the facts of the case.
I would be happy to discuss with you the correct language. Contact me if you would like my assistance.
