Legal Question in Insurance Law in Pennsylvania
Small claims court
Druken driver hits son's car parked in front of sons's home. Driver is arrested. Car is probably totaled. Book value is only 3800.00. However, son cannot afford another car or car payment and needs car for transportation to work. If driver's insurance will only give ''book value'' for car, can son go to small claims court to have judgement raised based on the fact that he has lost his transportation to work?

probably not. If he lost time from work, it is probably compenable. If the car had any improvements, the book value can be increased less depreciation for the improvements
