Legal Question in Insurance Law in Pennsylvania

Total loss

I was involved in a motor vehicle accident, my truck is a total loss. The other driver was a 100 % at fault, his insurance Co contacted me and said the truck was a total loss, and they would give me NADA for it, $6800.00. The problem is the truck is custom, over $7000.00 in aftermarket parts, would cost 12-15 thousand to replace, How can they get away with that??? Do I have any chance of recovering any money for all the aftermarket parts, the truck was in near mint condition, and parts were installed over a 2 year span. The truck was used as mobile advetisement for my buisness, own a custom aftermarket parts store.

You asked about negotiating an insurance settlement.

Can you say attorney? The insurance company wants to get out as cheaply as possible and will at the maximum offer blue book value of a vehicle. An attorney can help negotiate a fair settlement. It is always best when the attorney is hired early.

You also need to consider of any medical injuries.

Can the insurance company get away with it? Yes, they do all the time.

If there were no physical injuries that leaves you in somewhat of a dilemma because you probably will have trouble finding an attorney to handle the case for you on a contingency fee basis. I suggest that you may want to call the state insurance commission if you cannot find an attorney willing to handle it for you. They can sometimes help.
