Legal Question in Employment Law in Pennsylvania

Access to Personnel Files

I was with my employer for several years and left there about 3 months ago. I just recently asked for a copy of my non-compete form. I was informed that because I am no longer an employee, they cannot provide me with a copy. Is that legal, or do I have the right to have a copy of it? If I can't have a copy, am I legally allowed to view the item in their presence?

Re: Access to Personnel Files

You asked about getting a copy of your personnel record.

An employer must allow a person to examine their entire personnel records, whether or not that person remains an employee. They can demand the person view the records there but they also must allow copies to be made, at your expense.

Roger
