bad reference

I have recently discovered that my current supervisor may have given a bad reference to a company I was really hoping to work for. I am trying to find out if it was the reference that ended the process of interviews for me. If it was because of that, I believe my supervisor did it to be vindictive because she has a difficult time keeping staff and she probably wants me to stay working there. What is she allowed to say or not say to someone inquiring about my work performance? Thank you

Generally, an employer has a right to provide truthful information about an employee to a prospective employer. A cause of action exists, however, if the information is false and the statements made are actuated by malice or negligence, are made for an improper purpose (such as personal animosity) or includes defamatory matter not reasonably believed to be necessary for the purpose of evaluating the employee's work.

If your supervisor gave false information about you for the purpose of preventing you from getting another job, you may have a valid claim and should seek out a lawyer familiar with employment law issues.
