Legal Question in Employment Law in Pennsylvania
Bonus paid
I will be leaving my company on Oct. 5, 2002, and going to a new company. I earned a bonus in Aug. 2002. I have just been informed that all bonuses will be paid 45 days after the end of the year (Dec. 31) and I will not be recieving mine since I will no longer work for the company. I am not sue if this is legal, since I did earn it prior to my leaving. Any information you can give will be greatly appreciated.
Thanks,
Wayne

Re: Bonus paid
If your employer did not advise you at the time that you earned the bonus that it would only be paid if you were still an employee, then you should be entitled to collect it even after you leave. howver, an employer is free to set up a bonus program that specifies that only currently employed personnel will be paid. The answer depends on what was told to the employee during the time that the work was being performed.
