Boss blackmailing to receive pay

I work as an independent contractor and get paid with a 1099 form. My job entailed making sales calls for my boss and getting him clients. I use my own computer, buy my newspapers and keep track with a custom program my husband designed. I work in the office about 13 hrs a week and the rest I am on call to work from a home office to deal w/clients, about 5-7 extra hrs.

My boss decided to cut my commissions and I left the position on 11/10. He will not pay me what he owes me for Sept, Oct or Nov till he receives a printout and disk of my contacts. I feel he owns the clients I acquired and have given him all of that info. As an indepentent contractor I thought I retained the rights to the materials I used in doing my job.

I would like to know if he is entitled to this info and can he withhold pay till he recives.

Hopefully you have a written contract that details the obligations of the parties. If there is none, it would seem that the contacts came from your work product as an independent contrcator.
