Legal Question in Employment Law in Pennsylvania

New Boss

Hi

My husband is a coffee break server and has been working for this hotel for 15 yrs, and just got a new banguet manager. The new Banguet manager seems to have an ax to grind with my husband ( she is friends with a person my husband worked with years ago), anyway, the new manager wants to switch him to dinners and cut his hours down (ie.... changing his job description)can they do that???? I dont know where to look for information about his rights!! Please help this lonely and frustrated soul.

Probably yes. Unless your husband has a contract which says he cannot be demoted or switched he probably will have to accept the changes. In Pennsylvania an employer can change the terms of employment at any time. An employer cannot however alter the terms of employment for a discriminatory reason. For example, if your husband's hours were cut because he was a man or because of his religion or color or race then that would be discrimination. But, if the new Banquet manager just doesn't like your husband you are probably out of luck.
