Commission Help

I work for a small sales company basically doing telemarketing. I am suppose to be getting a 500 dollar check but my boss said that my returns ate up all my pay. He takes out the 25 dolla return shipping from my pay when it returns. Can he do this? I havent gotten a pay in almost a month because of returns supposedly. I am looking for a new job now but I need to know if I can make him pay me for those sales. I hope this doesnt sound confusing.

You asked about improper deductions made from a commission check.

It is completely improper and probably unlawful for an employer to deduct return shipping costs from pay.

When a sale is reversed it may be proper for the commission to be reversed. But I would also dispute this. Your job is to sell the product and when you close a sale you have successfully completed your task. When a product is returned then that is the fault of the company and does not reflect on you and does not diminish your production. To suggest otherwise is silly.

I would like to talk to you further about this as I would suggest you may have brought up a successful class-action situation.
