Legal Question in Employment Law in Pennsylvania

Company resfuses to pay last paycheck

I recently resigned from a company that I have worked for the last 17 months. The owner of this company now refuses to pay me most of the hours I worked during last months pay. There are no valid reason for not paying for the work ... the hours were punched in correctly and all work was completed satisfactorily. I have complete records for the hours worked.

I other situations, I know the owner often has gone to court in order to delay payments or hope that complaints will just go away.

What options do I have in this situation?

Thanks.

Re: Company resfuses to pay last paycheck

The Pennsylvania Wage Payment and Collection Law requires that you be paid based upon the agreement you had with you employer. If you have to sue to get paid the law provides that you are entitled to legal fees and possibly liqidated damages of up to 25% of the unpaid wages. You can ask the PA Department of Labor to help you collect or contact an attorney familiar with employment law.

Re: Company resfuses to pay last paycheck

Five words - Pennsylvania Wage Payment and Collection Act.

Levels the playing field by providing 25% liquidated damages ($500

minimum), can use agents and officers of corporations personally, and

(the best part) awards attorney fees if you win. Now the attorney

gets paid and you get all the money owed plus 25%. Must have an

agreement with your attorney to split the money in this way. Don't

let the employer jack you up, try a suit at the District Justice Level. If you are in SE PA I take these cases regularly on

a contingent or part contingent basis. You may have to pay court costs

and other fees. Bill McLaughlin, Esq. [email protected]
