Legal Question in Employment Law in Pennsylvania
discrimination
I have been employed by the same company for 27 years. I have managed the best store in the district for 4 1/2 years.
My supervisor called me in on Thursday and said I have been transferred to a new location and it is effective monday. When asked why such short notice he said he had that right. he told me my leadership abilities were ineffective at my present location, but the new location would benefit from my leadership skills. He told me my store was not up to company standards but is sending me to a store that does more business. I asked about my replacement and he is a male and I am female and over 40. He was notified about this at least 2 weeks before I was. He has 2 years with the company. My options were to accept the transfer or resign. do i have any kind of case. what are my chances of unemployment compensation if i resign or refuse to go to the new location? I do not want to leave the company at this time however I have rheumatoid arthritis and I am afraid this new store will make it worse because of the way it is set up.

Re: discrimination
The company has wide latitude in its business discretion to assign and act as is in its best business judgment. It is prohibited from acting in discriminatory manners in violation of various laws, including gender or disability.
The situation would be highly fact specific and I simply can't give you a quick answer without an interview.
I would be happy to discuss your options. If you would like to arrange an appointment, please contact me to do so.
