Discrimination against union member

I work for a healthcare system that has multiple hospitals and outpatient services under it. It just so happens that the hospital that I work for is the only Union hospital in the network. I am also a student through a local university where I do the clinical rotation at one of the other hospitals in the network, which is non-union. As students we are offered jobs at our clinical site as an opportunity to gain more learning experience. This hospital has denied me from employment as a student because I work for the other hospital that is the union facility. Is this legal? Can a non-union facility deny me from employment because I am already employed with a union facility? The union hospital is in NY and the non-union hospital is in PA.

You asked about discrimination in employment based on union representation.

This is actually a very specialized question which I doubt will be answered by one of my colleagues, and in fact I can't answer it. Your question involves labor law and I suspect there are very few labor lawyers on LawGuru. It is often a specialty within employment law.

You will have better luck if you see a labor lawyer (not just someone who advertises that s/he handles employment law). It will even be worth it to pay a small fee for an initial consultation.
