Employee Pay

If an employee cheats on their timecard, ex. marks they worked 8 hrs when they only worked 5 hrs, and are paid by the hr, does the employeer have the right to only pay them for 5. Should it be reported to Labor Relations, if employee threatens to file a claim? Employeer has 4 other witnesses that employee is cheating on timecard.

You asked about an employee filing a false time card.

An employee, if required, must file an accurate time card. An employer must then pay an employee for hours reflected on an employee's time card.

If an employee falsifies time worked then that is simple fraud and would not only be grounds for termination but also grounds for criminal prosecution. If an employer is aware that an employee has falsified time it must still pay the time that the employee has marked on the card unless the employee willingly changes the time to accurately reflect the hours worked.
