Legal Question in Employment Law in Pennsylvania

Employer vs Employee

Here is the long of the short of it. I worked for a major truck leasing company. I started July 1, 2008 as an apprentice with no prior diesel knowledge. In late February I started having pains in my body, I worked a saturday with 1 additional mechanic and was asked to change a 200+ pound clutch by myself, of which I had no knowledge on how to. I attempted the mechanics of it, but complained of pain and asked for assistance. The other mechanic agreed it wasn't the first time being asked to do something like this with one man. He assisted me in finishing up and we went home. Monday morning I woke up with my entire left side numb, I didn't know what to do, I went to my family doctor and she could not make a complete diagnosis but knew something was wrong. I notified my local office of me being ill and needed time off. They had me call corporate office who sent me Short Term Disability paperwork and FMLA paperwork. I filled out both and my dr put unknown for diagnosis. I was approved immediately for Disability but received a letter a week later saying they didnt know when my FMLA would shart and for how long. another week passed and I got a letter stating I was terminated. I ended up having quintiple bypass surgery. Im 28 years old.

Re: Employer vs Employee

Did the clutch installation involve such strain that you had a myocardial infarction on the job? did you experience nausea, tightness in jaw or shoulder/ other classic heart attack symptoms while in the course of employment?

You may have a WC heart case plus a FMLA case plus a wrongful discharge. When you are up for it, schedule a no-fee face-to-face with employment counsel.

Good Luck.
