Does my employer have grounds to sue?

I am leaving my job to build a startup company that will produce similar advertising products as my current employer. I am a partial owner, and my partner is also employed by my current employer. My partner has been approached by another employee asking to join us when we leave. Does my current employer have grounds to sue us for bringing another employee with us? Is there a time limit that we must wait before recruiting someone from our current company?

In situations like this, any employment agreements and/or covenants not to compete become vitally important.

It would take a review of those documents, to the extent that you have any, to fully answer your question.

There is a new law, the uniform Trade Secrets Act, which might protect your old employer's client information, etc. even if you have no written employment contract.
