Legal Question in Employment Law in Pennsylvania
Can an employer in Pennsylvania terminate an employee due to any of the following: background search employment gaps, omission of former employer, and negative reference after hiring the employee for a training program?
I was hired as an sales trainee under the pretenses of passing a State liscening exmaine. However upon backgroud search of the Hurman Resource division I was advised that two of my former employment dates were off from the fromer employer's records and that there is a employment gap which I need to send a email explanation. I did respond swiftly with the missing information and was advised two and half week of training later that I was being terminated. I asked what the reason for termination was and the human resource representative advised it was based on the telephone conversation regarding my date mix-up on my application. I was shocked and appauled considering not only were my dates off so were other employees that had been hired for the training program but I was let go. Is this legal? Also, they have all of personal background information and I wanted to know can I ask for my personal information back since I am no longer an employee?

You asked about being terminated after hiring.
Unfortunately an employer in PA can terminate an employee for any reason whatsoever so long as there is no unlawful discriminatory cause or effect. In this case the employer probably had no choice but to terminate given the inconsistencies. Had the employer not terminated at this instance then what choice would it have the next time such a circumstance presented?
Sorry about the misfortune. Now you can correct it and move on.
