Legal Question in Employment Law in Pennsylvania
Is employment bond really matters?
I was employed for a consulting company as a software consultant from January 12, 2002 to November 12, 2000. I was on bench from January 12, 2002 to April 23, 2000. I got a client on April 24, 2000 and worked for them for 6 month. My assignment with the client finished on October 24, 2000. I was again on bench for 18 days. My employer didn't find any client so far. My past experience and their current attitude pushed me to look for another job. I got a nice offer from another company and I joined them and I resigned previous employer. This happened some 1.5 years ago in November 2000. Now, I got a letter from my first employer's lawyer on March 15, 2002 asking me to give them $22,000 for the damage of the company and client. They are saying that I resigned them while I was on assignment with the client which is not true. I finished my assignment and I was on bench for 18 days. Moreover this employer had 1 year bond. I was with this employer for 10 months. I have enough friends who can verify that I was on bench when I left this company. I can pull out documents from the client too. Pls. let me know what step I should take againt their false allegations. Thanks much.

Unless you signed a contract in which you agreed not to terminate your employment for a certain period of time, your employer has no right to make a claim against you for damages caused by your leaving. Employment at will means not only that you can be fired at any time but also that you can quit without consequence. If you did sign a contract then you will need to have a lawyer review that contract and the surounding circumsatnces in order to get an answer to your question.
