Legal Question in Employment Law in Pennsylvania

employment fraud?

I recently took a position with a Consulting firm that has a contract with a large company. After leaving my previous position and starting this new one, they changed the job duties.

Originally, I was told no travel outside the tri-state area. Now, I am told that I am expected to be on the road out-of-state 4 days a week starting next month. This is completely different from what I was told and the Consulting firm even acknowledged that this is NOT what they told me intially. I explained that I would not have taken the job if I had known about the travel.

Now, there are 5 others in the same situation as I- we were all the same thing. We all left jobs or turned down other positions for this one.

Do we have any recourse? This is in Penna. which I know is an at-will state, but we were totally mislead in what the position was to be.

Thanks for any advice.

Re: employment fraud?

You asked about changed employment terms.

As you noted you probably do not have an employment action.

The good news is that you still have a good old-fashioned tort claim and probably some contract claims also. You must speak with an attorney to develop the potential of your claims.

It is possible that all the parties may bring the claim together. But that should be determined only after you have spoken to the attorney. Don't go into too much detail with your co-workers as you only want folks who are fully on board to be privy to your plans.

Call me if you would like to proceed.

Roger
