My husband's employertold him that he was being put on ''corrective action'' for his position as a shift supervisor. A corrective action is a discipline for unsatisfactory performance. He was told he could take the action or take this maintenance mechanic job that they have open. If he takes the ''corrective action'', he will have to perform better as whatever they say he is not performing well in. Up until this time, he had received no warinings or repramands of any kind. That was last Thursday and they still have not even verbally advise him of the so called corrective actions that he needs to take or what they feel he did wrong. They only push this maintenance position on him. He called HR to get copies of the documents pertaining to the meeting and she said that they were still working on the ''meat'' of the corrective action. Last night and this morning, his supervior called him pressuring him to make a decision even though they have not supplied him with any of the backup information for the corrective action, but said that it would be an uphill battle and the maintenance job would no longer be there. My husband has taken the maint. job because he is afraid of what they will do if he does not. Is this legal?

From the facts you have stated things do not seem correct as to what the employer did? Does your husband have any idea why this was done? Perhaps he is experiencing some form of protected discrimination. ie treated differently because of his age. There are other protected areas. He would be well advised to speak with an attorney about his particular case and provide additional information.
