Legal Question in Employment Law in Pennsylvania

Employment Law

I suing my former company for Breach of Contract where I had a written Employment Agreement. One of the priciples of the firm recently sent me an email telling me I was ''despicable.'' Can this be held against them in my litigation?

Yes, unless he has a lisp. Then it is called the "Suffering Succotash" Defense. (Viz: Sylvester the cartoon cat used to call his bird nemesis, "Despicable!")

Seriously, if there was hostility in getting you fired, the statement may help support a claim of intentional acting.

The comment may have arisen only after the principal learned his company had been sued. That would make it a mere fact indicating the opposing side's baseness - rather than meeting an indispensable element of a lawsuit.

Should the actor defame you with such words in the presence of unprivileged third parties, then you can pursue a slander action as an addendum to your contract lawsuit.

Good Luck.
