If I am working for a company for nine dollors an hour,and monday through friday , daylight houre and have weekends and holidays off,. They are fazing out that job. Do I have to take another posision for 2 dollors less an hour. I would have to work any of the seven days of the week and all shifts. Plus I would have to work all holidays. Could I refuse that job and collect unemployment benifits until I found another job.It is very uncomfortablt to be looking for another job,scedualing interviews and the likes while still working.

You asked about a constructive termination.

It is up to the claims examiner as to whether you can collect unemployment or not based on the facts they obtain. The situation you describe may be considered a constructive termination where the employer negatively changes the terms and conditions of your employment.

If your claim is denied initially then you may file an appeal of that decision. Appeals offer second opportunity to present your claim.

Given the current state of the economy you should consider carefully whether or not to quit before you have another job.
