Failure of Employer to honor contract agreement

My former employer refuses to honor my relocation contract. The contract was signed before I was relocated from their DC office to their Philadelphia office The contract states that the firm would provide me with 28 days of severance pay if I were terminated for no fault of my own. I was not let go due to any gross misconduct. Is my former employer responsible for paying the severance? They tell me they are not responsible because the original contract I signed when I first started with the company (which contains no clause about severance) supercedes the relocation contract.

The answers to your questions largely depend on the language of the two agreements to which you refer. Tentatively, however, it sounds as though those two agreements are distinct contracts.

If your employer induced you to relocate by promising a severance package, you are entitled to that severance no matter what the original contract said. Generally a later contract will always control and in this case it seems certain that the relocation contract would apply.
