Legal Question in Employment Law in Pennsylvania

harasment/hostile environment

I am on STD/FMLA because of mental distress from a hostile environment and stress caused by Supervisor. Is it legal to search for other employment while on leave from current position?

Re: harasment/hostile environment

You asked if it was acceptable or legal to seek other employment while on STD/FMLA leave.

It is without question legal. But its acceptability can be affected by an employment contract, company policies or even a union contract. If none of those exist or are silent on the issue then it is OK to seek other employment while on leave. Be warned though that if observed such actions may be seen by the insurer or the employer as cause for denial of coverage or termination.

Have you considered pursuing a claim for constructive discharge for your employment claim based on discriminatory or harrassment.

You should follow up with an attorney to discuss this matter and your potential courses of action.
