Legal Question in Employment Law in Pennsylvania

Harassment / Discrimination?

I work in a department store that is merging with another department store. We have been told by the personnel manager and the store manager that associates in ''good standing'' will survive the merger. Even though we are merging, they have hired new people that are younger. The standard for new associates seems to be different than for associates having 25 to 35 years of service, and are over 50 years of age. New associates get to attend seminars, receive sale information ahead of older associates, and they are permitted to have beverages and to sit while we are not aloud to do either. We have received a pamphlet concerning harassment, but it is clear that it has to do sexual conduct and sexual orientation; it does not address the obvious slighting of senior associates over new hires. Since this practice apparently is endorsed by the store manager and the personnel manager, are not the older associates being harassed into resigning by this behavior? Since we are ''at will'' employees I need advice. Do I let the behavior continue until this hostile working environment becomes so unbearable that I must resign or become severanced due to poor performance? At what point if any should one consider getting legal representation?

Re: Harassment / Discrimination?

Age is a protected class and therefore the company action may violate antidiscrimnation laws. You shoul contact an attorney to discuss filing a complaint with the EEOC which protects your rights to sue. I offer free consultations.
