Hiring and then terminating within one week due to overstaffing and employer neg

My husband was hired to work for a Harley Davison dealership, gave his notice to his former employer (2 weeks); went to work for the Harley Dealership, worked 6 days in one week; Returned to work on the following Monday and was informed by newly hired CPA, that the owner had overhired and overextended himself and therefore was letting my husband go.. another person, Inventory Control Manager who was hired and worked the same time period was also let go for the same reason.When they left they asked for their paychecks and were informed that they would get them in the mail. They also asked for at least one month's severance pay due to the fact that they had both given up their former jobs in good faith of working at their new jobs.

Although normally an employer has the absolute right to terminate employment for any reason or no reason, Pennsylvania law does provide for the possibility of an implied contract for a reasonable period of time where an employee has significantly changed their circumstances in reliance on a job offer. For example, a pennsylvania court has held that an employee who moved his family from out of state could reasonably assume that his employment would last a reasonable amount of time. There is no decision that has held that merely leaving one job for another is sufficient to create an implied contract, but under the right circumstances a court might make such a ruling. You should have your particular circumstances reviewed by a knowlegable lawyer to determine whether you might have a claim for breach of an implied contract.
