Legal Question in Employment Law in Pennsylvania
My husband has worked his current job for more than 25 years and has worked his way up the ladder into management. His superiors came to him and asked for his resignation, saying that it is not working out. His production rate is less than 1/2% lower than the other managers in the same position and he has a lot more seniority than most of them. His ex-boss had been let go less than a year ago and she had a lot less years with the company also. She was given a severance pay and received unemployment benefits. They are offering my husband 3 months paid health insurance and they say they will not dispute unemployment. Although, hw has no guarantee of that. First of all, do they have the right to ask for his resignation? It doesn't seem like they have grounds for letting him go. And does my husband have the right to expect a severance pay? It is bad enough that they are letting him go after all the time he has been there, but to not even offer him what they have offered other employees who were let go is humiliating. I would need to know more facts. However since your husband had more then 25 years at the job it would appear there may be at least an issue of age discrimination.
