Lay-off before 55
Aspects of my current role are drying up and my company has said that I will probably be laid-off in Sept. The problem is that they will not be backfilling any positions in the near future, so I probably will be laid-off. However, I will be 55 at the end of Sept. and there is no indication that they will keep me on at least until then. Unless that happens I will lose any future retirement medical benefits. Can they legally and do that? There has been no mention of any type of severance package either. Do I have any legal rights regarding this situation?

There may be some protection because you are an older worker over 40. The circumstance of your situation in relationship to other employees also would be relevant. You should speak to an attorney about this employment issue.

You asked about a potential issue with a pending layoff.
You need to speak with an employment lawyer immediately (today). Due to your timing needs there are particular strategies that you can pursue to protect your benefits.
