Legal Question in Employment Law in Pennsylvania

My manager "temporarily" laid me off until business picked back up. Instead of calling me back when business picked back up, he hired a new employee to take my position. I am the only person of African-American decent and was replaced by a person of Caucasian decent. My manager said I was not fired and that I didn't do anything to warrant this lay off, but I was the only person laid off.

You may need to file an eeoc complaint immediately for a determination of whether there was an illegal act. Short time limits do not delay and good luck.

The circumstances seems very suspect. I have handled many cases where an employer uses a smoke-screen to mask an unlawful motive. In the law, this is referred to as a pretext. You seem to have what the law refers to as a prima facie case of race discrimination. You should consult with a lawyer promptly because there are relatively short time limits for bringing a claim for discrimination. Feel free to contact me for a no cost telephoje consultation.
