Legal Question in Employment Law in Pennsylvania

Necessitous and compelling

My church employer in Pennsylvania, where I have been employed as Music Director for four and one-half years, has proposed a contract where my compensation is reduced by about 50%. I have no negative performance reviews, and I have an email from the Council President asking me to respond to the proposal, where she says, --name removed-- this is nothing personal, we just have move on''. What do I do?

Re: Necessitous and compelling

You asked about being fired via a pay cut.

And fired you are. They just haven't got the fortitude to do it to your face.

You do not have to accept the pay cut. Though they don't have to continue to employ you. They are just trying to fire you without having to pay the unemployment compensation. But because they have unilaterally changed the terms of the employment in a material manner then the termination is "no fault of your own."

The question always arises whether they are using the termination as an unlawful discriminatory tactic. And you haven't provided any facts to that regard.

You could make a counter offer. My suggestion would be that you are willing to do the work for half the pay, for half the hours that you previously worked, including alternate weekends off.

Regards,

Roger
