non-compete still enforceable?

Background:

Previously signed an iron-clad noncompete with a two-year duration and statewide limitation with employer. Subsequently, terminated employment but continued to consult on free-lance basis (not on payroll for 9 months). Recently, was rehired by same employer.

Question:

Is previous non-com annulled by rehiring? Or is the duration re-set?

You asked about a non-compete.

There is no such thing as an iron-clad non-compete. Lawyers would be out of work if there were. Our job is to find and exploit the cracks in the contracts that other people have written.

A contract runs from and through the dates in the agreement. There is no resetting of any term unless it is specifically written into a contract.
