Legal Question in Employment Law in Pennsylvania

I am an overtime nonexempt employee. In order to complete my assignments I have had to work non-paid overtime. I have documented over 200 e-mails that I have sent after 5PM. There are probably as many times finishing the days tasks that are not documented. On more than one occasion, my supervisor has asked me to do something after hours, even though I am still completing the days assignments, for none of which I was paid. On one occasion, my supervisor did my performance review after 5PM with no overtime consideration. Do I have legal standing and I need to know if the company I work for in Pennsylvania, but is registered in Delaware, is bound by the Federal FLSA laws concerning overtime exempt/nonexempt status?

If the company regularly does business in PA it is governed by both the Pennsyvania Wage Paymet and Colllection Act and the FLSA. Feel free to contact me for the name/contact information of a firm that focuses on these types of issues. It hink that you should speak with such a lawyer. Alternatively you can contact the Wage and Hour Division of the Pennsylvania Department of Labor and Industry or the similar unit of the US Department of Labor.

I can be reached at 610-584-9400 or via [email protected].

This answer to your legal inquiry is based upon the limited facts stated in your question. Accurate legal advice is based upon an exchange between a lawyer and a client. The lawyer can then ask about other facts that may change or confirm the answer. Without that exchange, this reply should be considered limited in value. You should rely on this answer only at your own risk. Direct consultation with a lawyer is always recommended. Answering your question does not create an attorney-client relationship.
