Overtime Pay

My aunt works as a manager in a retail store. She's salaried and receives $400/week. She's working in excess of 50 hours/week because of the holidays and her employer refuses to pay overtime despite the long hours. Is this legal or, as a retail employee, is she entitled to time and a half or similar compensation?

Additional information: the employer considers this a part-time position and as such will not provide benefits, e.g., medical or dental either.

Re: Overtime Pay

Federal overtime regulations recently changed making $455 a week the minimum salary payable. There is no requirements to provide benefits to a fulltime employee except were all full time employees recieve them. I offer free consultations.
