Legal Question in Employment Law in Pennsylvania

pay

My son works as a busboy at Red Robin. They cut the pay of all the busboys to $3.25 per hour from $6.25 per hour. They did this without any notice. Their paychecks just reflected the change. Is that legal?

Re: pay

You asked about an automatic paycut.

Two aspects. Because PA is an at-will work state the employer may unilaterally change a person's pay rate, but only with proper notice before the time is actually worked.

It is illegal for an employer to cut a pay rate for hours already worked.

If it is true that the employer did not provide notice then there is an excellent claim which may even be a class action matter.

An attorney can correct this matter.

Roger
