Legal Question in Employment Law in Pennsylvania
Performance Evaluations
My company recently conducted a peformance evaluation for a promotion, and now refuse to let me see my evaluation, saying it was done in ''Confidence''. Do I have a right to see it?

Re: Performance Evaluations
You asked about seeing items in your personnel folder.
Both Federal and state law require that an employee be provided access to their complete personnel folder. The access must, at the least, be made available for review at the place where the records are normally kept.
There may be some aspect of this situation that I am unaware, but the general rule is clear that an employee has a right to review his/her own personnel records. Any claim to confidentiality would likely be false.

Roger
