Legal Question in Employment Law in Pennsylvania

Recording Conversation at work

Can you record a conversation between two parties, (another individual and yourself), without that individual being aware that the conversation is being recorded? I have an employee who recorded conversation to play back to someone outside the workplace. In PA is this legal?

Re: Recording Conversation at work

You asked about recording and using that recorded conversation without consent of one party.

There is no clearcut answer. And that's why lawyer's exist. State statute gives a pretty good description of what is not allowed (18 Pa. Cons. Stat. Ann. 5703, 5704). But a good lawyer could create arguments no matter which side he/she represented.

But, in a civilized society it is extremely rude to discuss a private conversation with another person unless that speaker intended that conversation to be shared.
