recovery of wages and expenses

recently terminated, without warning or reason. Employer refuses to pay final wages, unused vacation (as dictated in company manual), expense per diem as agreed upon for work out of state, no 401K disclosure since inception (Oct,99), 401k was to have been matched at 50%, refuses COBRA claiming not required due to low number of employees (which is in doubt). What are my legal options? Do I have any recourse to collect on what this former employer owes? Also, have found out that other former employees facing same challenges. How can I determine if COBRA issue is valid?

Yes you do have rights to recover unpaid compensation. The Pennsylvania Wage Payment and Collection law gives you a right to recover the wages and counsel fees. ERISA gives you additional rights with respect to the 401k contributions.

COBRA applies to employers with 20 or more employees.
