Salaried Employees and Hours Worked

I am a salaried employee. My employer requires that I work no less than 50 hours a week. I did agree to this when I accepted the job 3 years ago. I've had some personal changes in my life, recently, and working 50 hours a week has become very difficult. I am considering renegotiating my schedule with my employer. My question is, however, does my employer have the right to force me to work more than 40 hours per week?

There is no law in Pennsylvania that prohibits an employer from requiring an adult employee to work more than forty hours. However, both state and federal law require that you be paid time and one half for hours over forty per week unless your job qualifies for an exemption. The fact that you are salaried and agreed to work fifty hours does not necessarily mean that you are exempt from the overtime pay requirements. You should consult with an attorney familiar with these laws. You may be entitled to up to three years back overtime pay.
