Legal Question in Employment Law in Pennsylvania

termination due to multiple job situation

At the time of hire I had informed my job that I had a second job as a DJ. I had given them two weeks notice of scheduled event and suggested a shift that I would be available for. My answer came the night before the scheduled event with a threat of termination if I can't make it in to work. I have a signed contract and received half the sum as a deposit to DJ. If I cancel the contract I can be held in breach and if I DJ the party I will be terminated from the other job. What are my options?

Re: termination due to multiple job situation

Your question answers itself:

Unless the DJ job pays tens of thousands of dollars, find another DJ to do the job for you, give notice to the booking party and then let them sue you if they wanted you specifically to perform. Let the substituting DJ know of any special songs, etc that the client requires.

Don' be pennywise and pound foolish. If you think any lawyer will get excited about representing you against your present employer should you do the DJ job, you are probably mistaken.

In short, if your employer won't let someone else cover, or if you don't want to make an issue of things as a new hire, follow my advice above.

Good Luck.
