RE: termination of employee health benefits
I work at an off-site location from my employer.In february, we had open enrollment, but do to an oversight, my open enrollment forms were never sent to me, causing my benefits to be terminated. I discovered this by looking at a paystub.
I alerted my supervisor to this who advised that she could do nothing about this. When i decided to leave my job, she quickly allowed me to sign back up, deciding it wasn't my fault that i hadn't received the information.
As of March 1st, i was to have been re-activated with healthcare benefits. Although the funds have been taken out of my paycheck, (in fact my most recent paystub and follow up phone call showed that they are ''double-dipping'' and taking an additonal amount to make me retroactive to february,) i still do not show eligibility from the health insurance plan's eligibility logs.
I'd like to know if there is a recourse. Can i recoup my last two months worth of health insurance benefits that were taken from my paycheck? thanks.

I have one question before I can definitively answer this inquiry. Did you incur any claims that were not covered during the two mnoths at issue? In other words, are you out of pocket for any medical expenses that would have otherwise been covered? If not, then I don't think that there's any legal recourse for you in this case.
