Legal Question in Employment Law in Pennsylvania

Unemployment Compensation Board of Review Appeal Brief

I am filing a brief, today, to the Commonwealth Court of Pennsylvania, Pro Se, with the Unemployment Compensation Board of Review as the Appellee. I have a sample brief, however, I am unsure of what error of law was committed or where to find the information. I was not present for the Referee hearing and they found for my exemployer, even though he lied stating that I was fired. My initial determination finding for me, stated my side and I was not fired from my job at the time. I filed an appeal to the UCBofR and they afirmed the Referee's decision. The sample brief I have has a table of authorities and I need a Scope of Review reference and a Standard of Review reference. Any answers you can offer will be a great help to be. Thank you for your time.

Re: Unemployment Compensation Board of Review Appeal Brief

You asked about writing a brief.

Many courts will give you leeway as to the exact form of a brief when filing pro se. But as to giving you direction, that's not going to happen.

Lawyers spend their lives learning and perfecting their writing. Briefs are our bread and butter and we can't simply tell someone how to write on in a forum. Every first year law student takes 12 credit hours on brief writing, spends the next two years understanding briefs better and then spends a decade in practice becoming a journeyman lawyer.

The courts publish online booklets about representing yourself pro se. You should look for it. Plan on spending days writing even a simple brief. It is not uncommon for an experienced attorney to spend dozens of hours researching, writing and revising a brief.

Regards,

Roger
