Legal Question in Employment Law in Pennsylvania

Unfair lay off??

My mother(age 61) was just layed off after 6 yrs. at her job without any reason or notice given. She was called into the office at the end of the day, told of the situation and was told ''Sorry, goodbye.'' It was very unprofessional. A younger girl was doing her job before some changes were made. The whole thing seems suspicious.

Re: Unfair lay off??

The law does not require an employer to be fair or professional with regard to lay offs. However, both Pennsylvani and Federal laws prohibit an employer from discriminating aginst an employee based upon age. Being replaced by a younger worker may be indicative of age discrimination but additional evidence would be required to prove the claim. If your mother believs she was a victim of age discrimination she should have her situation reviewed by a lawyer familiar with employment law as soon as possible.
