Legal Question in Employment Law in Pennsylvania

Violation of Retailiation Law?

I am employed at a Charter School.(Non union) I was given an impossible work load, and was told more staff would be hired. I have endured sever stress related health issues. I decided to inform the Board of Trustees of the wrong doings of the Leader in charge. The Board took action and removed the Leader from her position.

I just saw that my job (same job different title)has been advertised for internal and externally. I asked about this and was told legally they need to do this becasue it is a change in title for me and I will need to apply and be interviewed for this position. I am very concerned that I am being retailiated against. I have documentation for everything. Do I have a case? I will be honest and tell you that I am so burned out emotionally and physically that I need time off before I can even think about working again. I love to work and used to love my job. One thing to note is I never received a written employee agreement from my school this year. I walso never was evaluated on my performance. It has been humiliating to me because other employees are asking why my job is posted. I have been successfully employed for 2 years here.

Re: Violation of Retailiation Law?

Several questions.

What specific "wrongdoings" of the "Leader" did you complain about?

Did you have a written agreement in previous years?

It is unclear to me why they "legally" have to post/advertise your position.

With a few more specifics, I may be able to give you an answer to your questions.
