Legal Question in Employment Law in Pennsylvania
I work in a restaurant and my boss sent me to buy wine and got into an accident and damage my car, is my employer liable to the damage of my car?
1 Answer from Attorneys
If the accident was another's fault, you can pursue a claim against them. If the accident was your fault, your collision coverage will take care of it. You can also use your collision coverage if another was at fault and leave it up to your insurance company to pursue the claim against the other driver. Your insurance company cannot rate you for an accident that was not your fault. You can ask your employer but I would not press the issue if the employer does not voluntarily agree to pay. You are not on strong legal ground trying to make the employer pay.
This answer to your legal inquiry is based upon the limited facts stated in your question. Accurate legal advice is based upon an exchange between a lawyer and a client. The lawyer can then ask about other facts that may change or confirm the answer. Without that exchange, this reply should be considered limited in value. You should rely on this answer only at your own risk. Direct consultation with a lawyer is always recommended. Answering your question does not create an attorney-client relationship.
