Legal Question in Employment Law in Pennsylvania

Wrong Income - Who's to blame?

I recently received a paycheck for working but in the incorrect amount. I'm an assistant wrestling coach along with one other person. The school was supposed to pay each of us 650. They made a mistake and gave me a check for 180, and the remainder of my money went to the other person's pay check. I told the school and they said that I have to tell the other assistant to give me 470, because it's my money that was mistakenly given to him. He has yet to pay me that portion and I have made several attempts to speak with him. If I were to go to court, would my case be against the school for giving me the wrong amount or against the other assistant for not paying me? Thank you.

Your case is against the school which broke the contract to pay you for being the wrestling coach.

I agree with Atty. Johns. The other coach doesn't owe you anything. It is up to the school to recoup the money from him if he was wrongly paid. You have no action against the other coach.
