apt rental, security deposit
I am the landlady of a duplex apt, I live in lower apt. Upper apt was rented out to a young couple a few weeks ago, the had a big row, she left then cam back for her 'stuff'. There was a years lease but I let her dign off and she gave me keyw back.
Q: I beleive he her partner, still in apt, is responsible for giving her 1/2 her security deposit, is that correct? or do I the lanlady have to give her 1/2 back then get the 1/2 off him? thankyou CP

Understand, that I have NOT reviewed the lease in question, so I have no idea what it says--indeed, you would have drafted it, so I don't know what provisions you put in there.
However, with all due respect, you must understand one of the basic tenets of Landlord Tenant law--you are not obligated to slice up rental payments and security deposits. Unless you used a poorly drafted lease agreement, the rent is XXX per month, and the Security is XXX. It does not matter to you if ten people live in the apartment and pay with ten separate paychecks. If one of them is late, then rent has not been paid. So too is it with the security deposit. You should return none or all of it, but it is not a good idea to start playing banker and chopping it up. Again, I have not reviewed any of the documents, this responsibility is yours.
