breach of lease

My son signed a lease for an apartment, along with 3 other college students. This was a new building and the lease was to commence on the 1st day of June, 2006. The building was not finished by the 1st of June and the occupancy permit was not signed until June 23, 2006. Was the lease breached thus voiding it? Thank you.

Depends on what the lease says happens if landlord cannot deliver premises. Is this in VA? Did they take the place after that? If so what has transpired that prompted you to ask the question now? If not, what has transpired to prompt you ask the question now?
