Legal Question in Landlord & Tenant Law in Pennsylvania

collection of past due rent

My husband lived in an apartment with his ex and was evicted. This happened 11 years ago. In 2001, his ex-wife was checking her credit and noticed there was something on her credit. When she called they said that she and my husband owed $3300. for past duerent from 11 years ago. She set up--name removed--payment plan and made 3 payments and stopped paying. They have now contacted my husband for payment. They admitted they have never tried to contact him before and they claimed that they cannot locate his ex. They stated that this was--name removed--''lost file'', but when his ex called it reopened it. Can they collect from us even though this was 11 years ago?

Re: collection of past due rent

No, they cannot, as 11 years is past any applicable statute of limitations period, which is six years for a contract action, such as a lease. You should tell the collection agency that if they call again. Feel free to contact me at 609-397-8400 if you want to discuss this further.
