Can I evict my husband?

My husband is not on my lease (my daughter and I are), he has left the home, and has been gone for about 3 weeks now. He is a drug adict, and I do not want him to return once he is done with his binge, as he has done in the past. I can not afford a divorce at the moment, but do not want him to return to my home, where I pay all of the bills.

Absent an order of exclusive possession as part of a divorce action he has a right be there.

That said one way to achieve you goal is to file for a PFA. To do that you should check with the legal services organization for your county.
