Evicting Tenant

We have an apt. that we rent out to a couple who have from day one not paid their rent on time and have problems keeping the apt. clean. I sits over a restaurant. At this writing it is infested with roaches which has caused the business down stairs to be closed for a day. The business sprays once a week for the bugs. How much time do we need to give the tenants to move out. They are also substance abusers at which time the building is being under servalance. Do we have the legal right to evict within 30 days to protect the business down stairs because of the infectation problem.

Unless the lease says different you have to send them a notice to quit. This tells them they have 10 days to leave or you will sue for possession. If after 10 days they don't move then you file for possession with the DJ. With in 15 days there will be a hearing. If the judge grants you an order for possession then they will have 10 days to leave or you can ask on day 11 that the constable evicts them.
