i got a ''possession granted''in court and the tenant has moved almost all things out and does not live there,he has called for gas and electric to shut off.he has taken down a railing going to the basment which is a code violation and taken batteries out of the smoke detectors,or removed them entirely.i filed for possession and it has been posted on his door.can i take possession since there are safety issues involved?

Re: eviction

If you have been granted a Writ of Possession then you can retake the property. You have the right to retain the appropriate amount of money from the security deposit to reimburse for any damages they caused, including the code violation. If the security deposit is not sufficient to cover the damages then you can sue them for the difference.
